This Privacy Statement sets out Middleton Buyers Advocates’ policy with respect to the way in which we obtain, use and disclose information about you, including through our website at www.middletonbuyersadvocates.com.au .

Collection and use of personal information
Property owners (Sellers)
If you are selling a property which is being reviewed by us for our buyer clients, we have visibility of your details on contracts of sale for our clients. For the purposes of the sale itself, we store copies of the contract of sale itself however separately from this we do not store or use your personal or contact information that appears on the contract of sale. We are legally required to store this information for 7 years.
With that said, under new AML & CTF (Anti-Money-Laundering and Counter-Terrorism-Financing) laws, your selling agent or conveyancer may be obliged to provide us with your contact details and relevant information about you in order to comply with legislation. We are legally required to store this information on file for 7 years.
Tenants
If you are residing in a property that is being sold and which we are reviewing for our buyers, we have visibility of your details on contracts of sale for our clients. We are legally required to store this information for 7 years.
If you will be remaining in the property after the settlement date (when the purchaser takes over ownership, the pages from the contract of sale relating to your lease are shared with the purchaser's chosen property manager, who will in turn make contact with you to advise on the new management, and process for contacting them, paying rent etc.
Property Buyers
We collect personal information from you if you enquire about using our services or sign to utilise our services. We are legally required to store this information for 7 years.
For contract of sale and AML/CTF compliance purposes, your details are shared with selling agents and conveyancers for the purposes of making offers on property on your behalf, and noting you as the buyer on contract/s of sale. We also share with the selling agent for the purposes of the contract of sale the name of the lender you will utilise for your purchase, together with the finance amount you will require of the lender. SMSF and non-personal (eg company/trust) owners please note we also share relevant documents with selling agents and conveyancers that illustrate the entity structure, directors and shareholders.
Your details (plus any non-personal entity structures) and details relating to the purchase will be shared with the property manager taking over management of your property upon settlement. Should contacting you be difficult due to the working hours you keep, or the location you live, we will share information with the property manager regarding the best times of day to contact you.
We may gather additional information from you to help us understand your financial position and life circumstance, to ensure we are targeting properties that match your situation. This information may include salary information, whether you have a partner or spouse, whether you have children, and whether you have other assets and/or liabilities.
